New Jersey Teacher Files $1 Million Libel Lawsuit Against Student After Instagram Photos Spark Misconduct Allegations

A New Jersey high school teacher has filed a $1 million defamation lawsuit accusing a student and her family of spreading explicit images taken from his private Instagram account and falsely linking him to allegations of sexual misconduct involving a student.

Daniel Torsiello, a history teacher at Central Regional High School in Ocean County, claims the images and online posts caused severe reputational damage and placed both his teaching and coaching positions at risk. According to the complaint, the online allegations accusing him of having an inappropriate relationship with a student resulted in Torsiello being placed on administrative leave, despite no criminal charges being filed.

Court filings claim the dispute began after Torsiello gave a student access to the girls basketball team’s Instagram account so she could help post updates related to the program. The lawsuit alleges the student then used that access to enter Torsiello’s personal Instagram account, where she allegedly found explicit photographs and private conversations involving adults.

The complaint states that the student took screenshots of the material and circulated them among other students. Torsiello claims the screenshots later spread across social media alongside accusations that he had engaged in sexual misconduct with a student at the school.

According to the lawsuit, the allegations intensified after a local Facebook page published a Feb. 19 post claiming a student had come forward with accusations against Torsiello, though the filing states the post provided no details or supporting evidence.

Torsiello argues the accusations were false and says the posts damaged his reputation and professional standing. The lawsuit also claims he now faces possible job consequences involving his position as women’s volleyball coach at a local community college near his home in Toms River.

Because the allegations were allegedly shared through screenshots, social media posts, and written online statements, the case largely falls under libel law, which covers written forms of defamation. Under longstanding defamation principles, false accusations tied to criminal conduct or sexual misconduct are generally treated as especially serious because the statements can inherently damage a person’s reputation.

The case also raises privacy issues involving access to personal social media accounts and the sharing of private communications. Torsiello admits in the complaint that his private account contained explicit images and conversations involving adults, but argues the material was unrelated to school activities and was never intended to be shared publicly or with students.

On March 9, attorneys representing Torsiello sent a notice letter to the student and her family demanding a public retraction stating there was no evidence of sexual misconduct involving a student, removal of reposted material, identification of people who received the screenshots, and compensation for alleged reputational and financial harm.

Attorneys representing Torsiello argued in the notice letter that the private messages and images involved communications between adults and were deliberately distributed to harm the teacher’s reputation.

Court filings state the family did not respond to the notice letter before the lawsuit was filed. The complaint also says a separate letter sent to the Facebook page that allegedly circulated much of the material received no response.

School officials previously stated the district had no reports or information involving alleged sexual misconduct between staff members and students. A February statement from the district also acknowledged that students had accessed messages exchanged between adult staff members.
