‘Below Deck Mediterranean’ Star Nathan Gallagher Pleads Not Guilty to Assault, Choking Charges

“Below Deck Mediterranean” star Nathan Gallagher has pleaded not guilty to assault and choking charges stemming from an alleged confrontation with a woman at a Sydney-area apartment complex in December.

New South Wales Police arrested Gallagher on Dec. 27 after an alleged incident involving a 29-year-old woman the previous day. He was charged with assault occasioning actual bodily harm, intentionally choking a person without consent and common assault. Gallagher was later released on conditional bail.

The alleged victim was not identified in the police memo that first brought the charges to public attention. A separate court proceeding, however, names Gallagher’s former partner and fellow “Below Deck” cast member Gael Cameron as the protected person in an Apprehended Violence Application involving him. Cameron and Gallagher share a young son.

Under New South Wales law, an Apprehended Violence Order is a protective court order intended to prevent violence, intimidation, stalking or harassment. It is separate from a criminal conviction and does not itself establish that allegations against a defendant have been proven. Violating an AVO, however, can result in criminal charges.

Gallagher’s criminal charges also carry different legal requirements. Assault occasioning actual bodily harm involves an alleged assault that causes injury, while common assault does not require the same level of physical harm. Intentionally choking, suffocating or strangling another person without consent is a separate offense under New South Wales law.

Police have released few details about what allegedly occurred at the apartment complex. Authorities reported no serious injuries following the incident, and the allegations against Gallagher have not been proven in court.

Gallagher and Cameron’s relationship has been featured on “Below Deck Mediterranean,” where they met while working aboard a yacht and later became parents. The season currently airing on Bravo was filmed before Gallagher’s December arrest, meaning the events shown on the series predate the criminal allegations.

The legal proceedings are separate from the television storyline. The protective-order case can impose conditions restricting contact or other conduct, while prosecutors in the criminal case must prove the charged offenses beyond a reasonable doubt.

Gallagher is scheduled to return to Burwood Local Court on Sept. 1, when the criminal charges and related protective-order proceedings are due to continue.
