A former Netflix attorney has filed a civil lawsuit against the company and two of its senior labor relations executives, alleging she was terminated after reporting workplace discrimination and misconduct.

Nhu-Y Phan, who served as Counsel for Labor Relations, filed the complaint on July 21 in Los Angeles County Superior Court. The lawsuit names Netflix, Ted Sinclair, Senior Director of Labor Relations, and Jonah Cozien, Director of Labor Relations, as defendants. Phan brings nine causes of action, including claims of retaliation, harassment, wrongful termination, and negligent supervision.

According to the complaint, Phan joined Netflix in May 2021 and remained with the company for more than three years. She received positive performance reviews and a raise during her tenure. She alleges her working conditions changed after raising concerns about unequal treatment within the labor relations team. Phan, who is Asian American, claims she and other women of color were denied key assignments while white colleagues were given high-profile opportunities.

Phan also reported concerns about Cozien’s alleged conduct toward a junior employee, which she believed constituted sexual harassment. Following her internal complaints, she claims she was excluded from projects, faced growing hostility, and received her first critical performance evaluations. She was terminated on September 2, 2024, shortly after Sinclair assumed interim oversight of her department.

The complaint further alleges that, following her departure, two other women of color were passed over for promotions, with their responsibilities reassigned to white colleagues who had not previously held lead roles.

Phan is seeking compensatory and punitive damages and has requested a jury trial.
