Nick Reiner will face a maximum sentence of life in prison without parole if convicted of killing his parents, Rob and Michele Reiner, after Los Angeles County prosecutors announced Tuesday that they will not seek the death penalty.
District Attorney Nathan J. Hochman said his office reached the decision after reviewing the aggravating and mitigating factors in the case and consulting Reiner’s surviving siblings, Jake and Romy Reiner. Prosecutors had been weighing capital punishment because the charges include special-circumstance allegations.
“After a careful and thorough review of all these factors, the district attorney’s office will not be seeking the death penalty in this case,” Hochman said before Reiner appeared in court Tuesday.
Reiner, 33, is accused of killing his father, filmmaker Rob Reiner, and his mother, photographer and producer Michele Singer Reiner, inside their Brentwood home on Dec. 14, 2025. He has pleaded not guilty.
A Los Angeles County grand jury indicted him on two counts of first-degree murder with special circumstances, alleging multiple murders and murder by lying in wait. Prosecutors also allege that he personally used a knife during the killings.
Those allegations leave life without the possibility of parole as the most severe sentence available if Reiner is convicted as charged.
Reiner appeared before Los Angeles County Superior Court Judge Sam Ohta on Tuesday in a brown jail uniform and answered a series of questions before waiving his right to a speedy trial. Deputy Public Defender Kimberly Lyn Greene represented him at the hearing.
The court also addressed whether transcripts from the grand jury proceedings should become public.
Jake and Romy Reiner have asked that the transcripts remain sealed, arguing that releasing evidence surrounding their parents’ deaths would cause further trauma. Hochman said prosecutors would not oppose their request.
Ohta has kept the material sealed while the issue is litigated. Media organizations have until Sept. 30 to challenge the request, and Reiner is due back in court Oct. 7.
The grand jury indictment allowed prosecutors to move the case toward trial without a preliminary hearing, where a judge would otherwise determine whether enough evidence exists to continue the prosecution.
Much of the evidence presented to the grand jury remains under seal. The Los Angeles County Medical Examiner determined that Rob and Michele Reiner died from multiple sharp force injuries and classified both deaths as homicides.
Reiner was arrested in Exposition Park later the same day his parents were found dead. Prosecutors have yet to publicly detail a motive.
His defense has also been complicated by a separate dispute over money held in a trust established by his parents. Reiner was initially represented by prominent defense attorney Alan Jackson, with Jake and Romy expected to help pay his legal fees. Jackson later withdrew after that arrangement ended.
Reiner subsequently sought access to money from his trust to fund his defense and potentially rehire Jackson. A separate probate proceeding is examining whether California’s slayer statute could affect his access to those funds while he faces charges in his parents’ deaths.
Rob Reiner, 78, built a decades-long career that included his role on “All in the Family” and directing films including “This Is Spinal Tap,” “Stand by Me,” “The Princess Bride” and “When Harry Met Sally.” Michele Reiner, 70, was a photographer and producer.
Hochman said Tuesday that the murder trial will not begin in 2026. Reiner remains jailed without bail and is scheduled to return to court Oct. 7 as the dispute over the grand jury records continues.
