Innocence Project Seeks to Reopen Scott Peterson Case

The infamous Scott Peterson case takes a new turn following the Los Angeles Innocence Project's willingness to represent Peterson and fight his decades-old conviction. Peterson is currently serving a life sentence for the murder of his pregnant wife Laci and their unborn child.

The Innocence Project is a non-profit legal organization dedicated to exonerating individuals who have been wrongfully convicted of crimes they did not commit. Through DNA testing and legal advocacy, the organization works to uncover new evidence, challenge flawed convictions, and secure the release of innocent individuals from prison.

In a criminal law case, when compelling new information surfaces it can pave the way for a case to be reopened. This process typically begins for a motion for a new trial filed by the defense. The court then evaluates the new found evidence, considering its potential impact on the original verdict. This evidence must be not only newly discovered, but also relevant and substantive enough to potentially change the outcome of the case. In this instance, DNA testing can be pivotal, shedding new light on previous decided matters.

On December 24, 2002 Laci Peterson was reported missing by her husband Scott. He claims to have left early the morning of her disappearance to go fishing in a town approximately 90 miles from their Modesto home.

Concerns first arose when responding officers encountered Scott’s noticeably calm demeanor and lack of concern for Laci. Scott explained to investigators that he tried calling Laci in the afternoon, but was only able to reach her voicemail. Upon his return home, her car was found in the driveway, along with her wallet, keys, and purse located inside the home, yet Laci was nowhere to be found.

The search for Laci Peterson garnered mass media coverage and captured nationwide attention. On April 13th, 2003 a full term fetus was reported to have been found along the San Francisco Bay shoreline. The following day, reports of a woman’s decomposing body had also been found washed ashore the San Francisco Bay near the location where Scott claimed to have been fishing. The two were found approximately a mile apart from each other and DNA results confirmed them to be Laci and her unborn child.

The Innocence Project is representing Scott Peterson based on newly discovered evidence related to stains from a mattress in a burned van found a day after Laci’s disappearance.

The van was located in close proximity to Laci and Scott’s home and was presumed to have been intentionally set on fire. The Innocence Project is investigating if the burned van contains any DNA evidence of Laci as it was previously rumored that her murder could be attributed to being a witness of a burglary that occurred near the time of her disappearance. If the reassessment of the van leads to identifiable and testable blood, it could have significant implications for the Scott Peterson case.

Scott has maintained his innocence since Laci’s disappearance.
