Kim Zolciak’s 15-year-old son, Kroy “KJ” Biermann Jr., has pleaded not guilty to seven felony charges in a sexual assault case in Georgia and is now asking a judge to move the prosecution from Superior Court to juvenile court.
Attorney Jason Sheffield entered the plea Monday, October 5, 2026, on Biermann’s behalf, denying every count in the indictment and waiving a formal arraignment scheduled for October 14. The defense also wants the court to decide the juvenile-transfer request before setting pretrial or trial dates.
Biermann was indicted September 3 on aggravated child molestation, aggravated sexual battery, aggravated sodomy, false imprisonment, and three counts of sexual battery against a child under 16. The charges stem from an alleged April 23 encounter with a female classmate at a Life Time Fitness location in Alpharetta, Georgia.
Prosecutors allege Biermann sexually assaulted the girl after the two entered a sauna at the gym. Biermann denies the accusations, and his attorney has maintained his innocence.
The latest filing puts the location of the prosecution at the center of the case. Biermann is 15, but Georgia law places some serious felony cases involving juveniles directly within Superior Court jurisdiction. Sheffield is asking the judge to transfer the case to Fulton County Juvenile Court before the Superior Court establishes the next phase of the proceedings.
Biermann was initially arrested in August on aggravated sodomy and aggravated sexual battery charges. A Fulton County grand jury later expanded the case to seven felony counts in the September indictment.
He spent more than a month in juvenile detention before Fulton County Superior Court Judge Melynee Leftridge granted him a $200,000 bond during a September 11 hearing.
The judge imposed strict conditions on his release. Biermann must live with Zolciak, attend school virtually, and remain under electronic monitoring. He surrendered his passport and cannot use a cellphone or social media. He is also prohibited from contacting the alleged victim, her family or associates and from having contact with anyone age 16 or younger.
The bond proceedings also brought renewed attention to an earlier juvenile matter involving Biermann.
During the hearing, prosecutors said investigators had previously recovered material from his phone involving an underage family member and cited that history while arguing over the terms of his release. Sheffield disputed the prosecution’s characterization of the earlier case.
The defense attorney said the prior matter involved inappropriate conduct between two middle-school-aged children and did not result in an adjudication for statutory rape, sexual intercourse, or a comparable offense.
That juvenile proceeding is separate from the seven charges now pending in Superior Court.
Prosecutors have also sought permission to conduct forensic interviews with other minors as part of the investigation. In a September filing, the state told the court it had a good-faith basis for concern involving additional minors and asked that sensitive evidence connected to the request be considered privately by the judge.
Zolciak has publicly defended her son since his arrest. She has said he denies the allegations and cited a voluntary polygraph examination as well as the reported absence of his DNA from evidence collected after the alleged April encounter.
Those claims remain part of the defense position rather than findings by the court. Biermann’s not-guilty plea formally places all seven charges in dispute.
The October 5 filing also seeks additional time for the defense to file motions after receiving discovery from prosecutors. Separately, the judge approved requests to seal material submitted in three confidential filings, leaving their contents outside the public court record.
With the arraignment waived, the next significant question is whether Biermann will continue facing the seven felony counts in Fulton County Superior Court or whether the judge will allow the case to proceed through the juvenile system.
No ruling on the transfer request had been publicly reported as of October 6, 2026. Biermann remains free on bond while the criminal case continues.
